Is Andrew Tate in jail?

Last reviewed

As of 3 October 2026: held in US federal detention in Miami after his arrest by the US Marshals Service on 18 July 2026 on a UK extradition request. On 9 September 2026, in a written order following an 8-hour detention hearing on 27 August at which both brothers testified, US Magistrate Judge Lauren Louis denied bail — finding they had failed to demonstrate the special circumstances that would justify release in an extradition case — so he remains in custody; the UK has since lodged its formal extradition request with the US, which the State Department is now reviewing for compliance with the UK–US treaty. No source we have reviewed records any criminal conviction against him, and he denies all charges.

Detained at the request of UK prosecutors pending extradition proceedings; the US process decides surrender only, not guilt, and he denies all of the underlying charges.

A serious new criminal matter in Massachusetts: a complaint charges Peters with rape, administering a substance for sexual intercourse and procuring alcohol for a person under 21, over an alleged 23 May 2025 incident in Chatham on Cape Cod. A clerk-magistrate found probable cause on 4 September 2026 and the complaint issued on 8 September; the charges were reported publicly on 22 September. These are untested allegations that Peters denies — his attorneys say the encounter was consensual; he lives in Florida, is not in custody, is presumed innocent, and has not yet been arraigned (scheduled for 14 October 2026). Two earlier 2026 Florida matters are both resolved: a misdemeanour battery and conspiracy case prosecutors declined to file, and an Everglades firearm charge resolved by a no-contest plea.

Misdemeanour battery and criminal conspiracy to commit battery over an alleged February 2026 altercation at a short-term rental near Kissimmee
